Welcome to Waychit. These Terms of Service ("Terms") govern your access to and use of the Waychit mobile application, website, and all related services (collectively, the "Services") provided by Waychit ("we", "our", or "us"). By using our Services, you agree to be bound by these Terms.

1. Eligibility

To use Waychit, you must:

• Be at least 18 years of age
• Be a resident of or legally present in The Gambia (or a supported jurisdiction)
• Provide accurate and complete registration information
• Comply with all applicable laws and regulations

2. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide truthful, accurate, and up-to-date information
• Complete any identity verification procedures we may require
• Immediately notify us of any unauthorised use of your account
• Not share your account credentials with any third party

3. Services

Waychit provides a digital payment platform that enables you to:

• Make payments for goods and services (fuel, airtime, internet, school fees, etc.)
• Link multiple payment methods (mobile wallets, bank cards, bank accounts)
• Access merchant and point-of-sale solutions (for business users)

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

4. Payments and Transactions

• All transactions are processed in Gambian Dalasi (GMD) unless otherwise stated
• Transaction fees may apply depending on the payment method and service used
• Completed transactions are generally final and non-reversible
• We are not liable for failed transactions caused by insufficient funds, network issues, or third-party payment provider errors
• Refund policies vary by merchant and service type

5. Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose, including money laundering or fraud
• Provide false or misleading information
• Attempt to gain unauthorised access to our systems or other users' accounts
• Use the Services to transmit harmful software or malicious code
• Interfere with the proper functioning of the platform
• Engage in any activity that violates the rights of others

6. Intellectual Property

All content, trademarks, logos, and intellectual property associated with Waychit are owned by or licensed to us. You may not copy, modify, distribute, or create derivative works from any part of our Services without our prior written consent.

7. Limitation of Liability

To the maximum extent permitted by law, Waychit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold Waychit harmless from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

9. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or applicable laws. You may close your account at any time by contacting our support team. Upon termination, any pending transactions will be processed or reversed as appropriate.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of The Gambia. Any disputes arising from these Terms shall be resolved through the courts of The Gambia.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and revising the "Last updated" date. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
